        NOTICE OF PUBLIC HEARING

              CITY OF DANIA BEACH, FLORIDA

 

A Public Hearing will be conducted by the City of Dania Beach Planning & Zoning Board on the following date to consider the following application:

 

The Planning & Zoning Board will be conducting a “Hybrid” meeting in the Commission Chamber with limited public access and utilizing communications media technology (“CMT”) for additional access, in accordance with Ordinance No. 2021-012, adopted February 9, 2021, and Resolution No. 2021-070, adopted May 11, 2021, related to conducting public meetings while under the public health emergency related to the spread of Novel Coronavirus Disease 2019 (COVID-19).

SUBJECT:   TX-062-22: The applicant, the City of Dania Beach, is requesting a text amendment to the City’s Code of Ordinance, related to the allowable treatment of swales. 

 

         The following is the proposed Ordinance of the matter:

 

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 22, ENTITLED “STREETS AND SIDEWALKS”,  AT SECTION 22-5, ENTITLED “PAVEMENT, IMPROVEMENT AND USE OF SWALE AREAS”; AMENDING CHAPTER 28, ENTITLED “LAND DEVELOPMENT CODE”, AT ARTICLE 415 ENTITLED “SIDEWALKS AND SWALES” TO UPDATE ALLOWABLE SWALE TREATMENTS; AND AMENDING ARTICLE 725, ENTITLED “DEFINITIONS”, AT SECTION 725-30 ENTITLED “TERMS DEFINED” TO INCLUDE FLORIDA FRIENDLY LANDSCAPING AND XERISCAPE; PROVIDING FOR CODIFICATION, PROVIDING FOR CODIFICATION, CONFLICTS; SEVERABILITY; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE.

Please be advised that if a person decides to appeal any decision made by Local Planning Agency, the Planning and Zoning Board or the City Commission with respect to any matter considered at this hearing, such person will need a verbatim record of the proceedings and for this purpose such person may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to based. The City does not provide or prepare such record pursuant to F.S. 286.0105.
